India Losing its Domestic Arbitration! The Need for Legislative Amendment
Article 67 of the Schedule to the Limitation Act, 1963, prescribes a period of 12 years from the determination of tenancy for recovery of possession of an immovable property by a landlord from a tenant. What that means is it the tenant fails to vacate the premises upon the determination of the tenancy, the landlord must file a suit for recovery of possession of such determination o tenancy. Therefore, any suit for possession filled by a landlord beyond the statutory 12-year period would be barred by limitation.
