The term ‘leasehold’ bears a different connotation from the word ‘lease’, as we ordinarily understand and use these terms. Lease of an immovable property is a transfer of a right to enjoy such property, express or implied, in consideration of rent paid or promised to be paid. Leasehold, on the other hand, generally connotes a perceptual/long lease granted by the president of India/Government (Title Paramount) in favor of the lessee. To put it simply a leasehold right connotes a partial ownership in favor of the lessee. The right of the lessee in a leasehold property is better than those of a lessee in a simple lease, but less than that of an owner. The term title paramount, in itself signifies better title in favor of one against the other and in a leasehold property, the title of the government is better than that of the lessee.
