India Losing its Domestic Arbitration! The Need for Legislative Amendment
Section 108(B)(m) of the Transfer of Property Act, 1882 (TPA) imposes an obligation on tenants to keep the leased premises in good condition and to restore the property in “as good a condition as it was at the time when the landlord put the tenant in possession, subject only to reasonable wear and tear and irresistible forces.”
The provision also lays down that the landlord and/or his agents are authorized at all reasonable times to enter the property to inspect it. The tenants is bound to make good all defects caused by him, his servants or agents.
