India Losing its Domestic Arbitration! The Need for Legislative Amendment
In this article, we deal with the legal aspects of damage caused by the tenant to the leased premises and the remedies available to the landlord. Section 108(B)(o) of the Transfer of Property Act, 1882, casts a duty upon the lessee to use the leased premises the way a person of ordinary prudence would use the premises as if they were his own; to use the premises for the purposes granted; to not commit any other act which is destructive or permanently injurious to the premises. If the tenants acts in a manner contrary to the above, the lessor would have an actionable claim against the tenant for breach of the contract.
